Trademark Registration in Delhi

What is Trademark Registration?

Trademark registration is the legal process of protecting your brand name, logo, slogan, or symbol under Indian law. Once registered, only you have the right to use that mark for your business.

In India, trademarks are governed by the Trade Marks Act, 1999, and are registered with the Office of the Controller General of Patents, Designs & Trade Marks (CGPDTM).

A registered trademark gives you:

  • The legal right to use ® symbol next to your brand
  • Protection against copied or similar marks
  • The power to take legal action against infringers
  • A valuable business asset you can sell, license, or franchise

How It Works

Trademark Registration Process – Step by Step

Trademark Search

Before applying, a thorough search is done on the IP India database to check if a similar or identical mark already exists. This reduces the risk of rejection.

Choosing the Right Class

Based on your business activity, the correct class (or multiple classes) is selected. This is a critical step — wrong class selection means your brand remains unprotected in your actual area of business.

Application Filing (Form TM-A)

The application is filed online on the IP India portal. At this stage, you can start using the ™ symbol with your brand name.

Examination

The Trademark Office examines your application within 3 to 6 months. If they find any issues, they issue an Examination Report (objection). You need to respond within 30 days (extendable up to 2 months).

Publication in Trademark Journal

If the application is accepted after examination, it is published in the Trade Marks Journal. Any third party has 4 months to oppose the mark.

Registration & Certificate

If no opposition is filed, the trademark is registered and you receive the Registration Certificate. You can now use the ® symbol.

Renewal (Every 10 Years)

A registered trademark is valid for 10 years. It can be renewed indefinitely by paying the renewal fee.

Why Delhi Businesses Should Register Their Trademark Now

Delhi’s market is competitive. If you are running a business in Delhi — whether in retail, food, fashion, technology, education, or services — there is a real risk that another business may use a name or logo similar to yours.

Common risks of NOT registering your trademark:

  • A competitor can register a similar name before you and legally stop you from using it
  • You may have to rebrand your entire business, losing years of brand building
  • You cannot stop others from copying your logo or brand identity
  • No legal recourse against counterfeit products using your brand

Trademark Objection and Opposition in Delhi

What is a Trademark Objection?

An objection is raised by the Trademark Examiner if they find any issue with your application. Common reasons include:

  • Mark is too descriptive or generic
  • Similar mark already exists in the same class
  • Mark violates any legal provisions

A well-drafted reply to the objection, backed with proper evidence and legal arguments, can get your application accepted.

What is a Trademark Opposition?

After journal publication, any third party can oppose your trademark within 4 months. Common grounds for opposition:

  • Opponent claims prior use of the same or similar mark
  • Opponent claims the mark is deceptive or misleading

Both objections and oppositions require professional legal handling to protect your application.
