Trademark Registration Process – Step by Step
Before applying, a thorough search is done on the IP India database to check if a similar or identical mark already exists. This reduces the risk of rejection.
Based on your business activity, the correct class (or multiple classes) is selected. This is a critical step — wrong class selection means your brand remains unprotected in your actual area of business.
The application is filed online on the IP India portal. At this stage, you can start using the ™ symbol with your brand name.
The Trademark Office examines your application within 3 to 6 months. If they find any issues, they issue an Examination Report (objection). You need to respond within 30 days (extendable up to 2 months).
If the application is accepted after examination, it is published in the Trade Marks Journal. Any third party has 4 months to oppose the mark.
If no opposition is filed, the trademark is registered and you receive the Registration Certificate. You can now use the ® symbol.
A registered trademark is valid for 10 years. It can be renewed indefinitely by paying the renewal fee.
